Terms of Service

Parties

These Terms of Service (“Terms”) apply between:

• the app operator: Lidmila Maršálková, ID: 05684447, not a VAT payer, registered address: Jindice 115, 285 04 Rašovice-Uhlířské Janovice (“operator” or “we”).
• the app user (“user” or “you”).

These Terms govern your use of the mobile applications (the “App”). By downloading, installing, or using the App, you agree to these Terms.

1. Definitions

• App – a mobile application provided via Google Play or the App Store.
• Agreement – the contractual relationship between the operator and you, formed by downloading, installing, or using the App.
• User – a person who installs and uses the App.

2. Service scope

We operate the following mobile applications:

• BetterShelf – management of cosmetics and home goods, expiry tracking, organization into virtual shelves, and AI product recognition.
• DreamWitness – dream interpretation using an offline symbol dictionary and an AI consultant. App outputs are intended solely for entertainment and education and do not replace professional psychological advice.
• Kvitta – shared expense tracking and automatic debt settlement. Calculations are for informational purposes only and do not replace professional financial advice.
• BetterMingle – group event planning and coordination including shared expenses, voting, carpooling, room assignments, and group communication.
• TAROTIQ – AI tarot readings with a personal fortune teller Madame Stella, daily card, card library, and personalized interpretations. App outputs are intended solely for entertainment and education and do not replace professional psychological or other professional advice.
• Beanio – coffee recipe recommendations based on your machine, drink type, and coffee beans, brew logging, taste rating, and gamification. Recipes and recommendations are for informational purposes only and do not replace professional barista advice.
• Lucciola – an evening digital detox app where you grow a virtual “tree of life” with the firefly Lucciola. It is for fun and motivation only and is not a medical or therapeutic service. Available on the App Store and Google Play.

Features are available after installation and may be free or paid depending on the app and chosen plan.

3. Download and availability

• You download and interact with the App through the Google Play Store or the Apple App Store.
• All payments, cancellations, refunds, and license management are handled by the respective store and subject to its terms.

4. Pricing and payments

• Each app has its own pricing listed on its store page.
• BetterShelf: monthly, annual, or lifetime subscription as listed on Google Play; the free version includes ads, Plus is ad-free.
• DreamWitness: free tier (2 dream analyses per week) + lifetime Plus (CZK 149); the free version includes ads, Plus is ad-free.
• Kvitta: pricing will be published when the app launches on Google Play; the free version includes ads.
• BetterMingle: pricing will be published when the app launches on Google Play; the free version includes ads, Pro and Business versions are ad-free.
• TAROTIQ: 3 free AI readings for new users + daily card always free. Additional readings cost coins (packs of 5, 15, or 50 coins) as listed on Google Play; the free version includes ads.
• Beanio: pricing will be published when the app launches on Google Play; the free version includes ads, Plus is ad-free.
• Lucciola: free with ads (rewarded and interstitial); an optional Premium subscription and in-app currency “seeds” (virtual items with no monetary value). Available on the App Store and Google Play.
• Payments are processed by the respective app store and follow its terms.
• If you are eligible for a refund under the store's rules (typically within 48 hours), follow the process described by that store.

5. Intellectual property

The App and all its content (code, graphics, text) are protected by copyright. Ownership remains with the operator. You may not copy, modify, distribute, or create derivative works without prior written consent.

6. Liability

• The App is provided “as is” without warranties of fitness for a particular purpose.
• We are not liable for damages arising from the use of the App, unless required by law.
• The operator is solely responsible for the content within the App.
• AI outputs in the DreamWitness app (dream interpretation) may be inaccurate or incomplete. We are not liable for decisions made based on them; outputs do not replace professional psychological advice.
• Calculations in the Kvitta app are for informational purposes only. We are not liable for financial decisions made based on these calculations; outputs do not replace professional financial advice.
• Expense calculations in the BetterMingle app are for informational purposes only. We are not liable for organizational or financial decisions made based on app data.
• AI outputs in the TAROTIQ app (tarot readings) are intended solely for entertainment and education. We are not liable for decisions made based on them; outputs do not replace professional psychological, health, legal, or financial advice.
• Recipes and recommendations in the Beanio app are for informational purposes only. We are not liable for brewing outcomes based on these recommendations; outputs do not replace professional barista advice.

7. Privacy

See our Privacy Policy for how we process personal data collected via the App.

7a. Cookies and website analytics

On the website, we use analytics cookies (Google Analytics) only after your consent via a cookie banner. Without consent, analytics scripts do not load.

8. Termination

• You can stop using the App at any time by uninstalling it from your device.
• The operator may discontinue access to the App (e.g., end support), with prior notice where reasonably possible.

9. Withdrawal and refunds

Withdrawal and refunds are handled by the respective app store according to its policies (usually within 48 hours of installation). Subsequent disputes are processed by that store, not the operator.

10. Changes

We may update these Terms at any time. The new version becomes effective once published in the App or on the website. If you disagree, stop using the App and uninstall it.

11. Governing law and disputes

These Terms are governed by Czech law. Disputes are resolved by competent courts of the Czech Republic. Consumer protections under applicable laws prevail where relevant. As a consumer, you have the right to out-of-court dispute resolution through the Czech Trade Inspection Authority (ČOI).

12. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
